Consequences of Restraining Order

In Massachusetts, a domestic restraining order is referred to as a "209A Order." The 209A Order, issued by a court, may require you to vacate your home immediately, prevent you from contacting your spouse or domestic partner and prevent you from visiting or seeing your children. It may also require you to surrender your firearms license or firearms identification card as well as any firearms you own or possess. Violation of a 209A Order is a crime punishable by a fine of not more than $5,000 and/or by imprisonment for not more than 2 1/2 years in the house of corrections.

Criminal Charges for Domestic Violence

If you have been served with a 209A Order and choose not to hire an attorney, you may inadvertently do something that will result in a criminal complaint for domestic violence. Allegations of domestic violence can arise between spouses, domestic partners, parents and children, or grandparents and grandchildren. In a divorce proceeding, one party may accuse another of committing domestic violence and seek a restraining order out of revenge or for perceived or real threats.

Attorney Bennett works with experts and seasoned investigators to identify and interview witnesses to any alleged act of domestic violence. He will thoroughly investigate and explore every avenue to develop the strongest possible defense.

Beware Immigration Consequences

Attorney Bennett is also aware that allegations of domestic violence pose a dire threat to clients who are not citizens of the United States. A conviction may result in deportation, denial of reentry to the United States, and/or denial of naturalization. Attorney Bennett will work with you to minimize or eliminate, if possible, the likelihood of any adverse immigration consequence.
